These Terms of Service (“Terms”) govern your use of higherselflife.com and our forms, booking, donation, directory, and communication tools (together, the “Services”). By using the site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. Acceptance of These Terms

By accessing the site, submitting a form, booking a session, making a donation, or otherwise using the Services, you accept these Terms on your own behalf and, if you are acting for an organization, on its behalf.

2. About & Eligibility

higherselflife.com is operated by HigherSelf (doing business as HigherSelf), a 501(c)(3) nonprofit organization (EIN 46-0670042) based at 7 Warren Street, Newark, NJ 07102. HigherSelf provides community programs, resources, a partner directory, and events, including programs and partner relationships such as The 7 Space. You must be able to form a binding agreement to use the Services; some features are intended for adults.

3. Acceptable Use

You agree to use the site lawfully and not to:

• attempt unauthorized access to the site, its data, or its systems;
• interfere with or disrupt the site’s operation or security;
• harvest other users’ data, or scrape the site at scale;
• transmit malicious code, spam, or fraudulent content;
• impersonate anyone, or harass or abuse anyone through our forms, email, or phone lines;
• misrepresent your affiliation with HigherSelf or any listed program or partner;
• use the Services to violate any law or third-party right.

We may suspend or terminate access for any violation, and may report unlawful activity to the authorities.

4. Programs, Resources & Events

We offer educational content, a community resource and partner directory, and occasional programs, bookings, and events. Directory listings and third-party resources are provided for community benefit and convenience; we do not guarantee, endorse, or take responsibility for any listed organization, and inclusion is not a recommendation. Program and event details may change, and places may be limited. Booked sessions or appointments are scheduled through our tools and are subject to any specific terms shown at the time of booking.

5. Donations

Donations to HigherSelf are voluntary gifts that support our charitable mission and are processed securely through GiveWP and Stripe. Tax-deductibility, receipts, refunds for errors, and recurring-gift cancellation are governed by our Donation Policy, which forms part of these Terms.

6. Intellectual Property

The site, its design, code, text, graphics, and the HigherSelf name and marks are owned by us or our licensors and are protected by intellectual-property law. You may view and share our public content for personal, non-commercial purposes with attribution, but you may not copy, republish, or use our content or marks commercially, or in a way that implies endorsement, without our written permission.

7. Your Content

You keep ownership of the content and materials you provide (for example, a message, a form submission, or a directory suggestion). You grant us a limited license to use them only as needed to operate the Services and deliver what you asked for. You confirm you have the rights to any content you give us and that it does not infringe anyone’s rights or break any law.

8. Third-Party Services

The Services rely on third parties (e.g. Stripe and GiveWP for donations, Amelia for booking, Resend and Beehiiv for email, Twilio for SMS, SiteGround for hosting). Your use of those features may also be subject to their terms, and we are not responsible for their acts or omissions. Links to third-party sites are provided for convenience and are not endorsements.

9. Disclaimers

The Services and our content are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or secure. Our content is for general information and community benefit only and is not medical, mental-health, financial, or legal advice; always seek a qualified professional for your specific situation, and in an emergency call your local emergency number.

10. Limitation of Liability

To the fullest extent permitted by law, HigherSelf and its officers, directors, staff, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Services. Our total aggregate liability for any claim relating to the Services will not exceed US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless HigherSelfand its officers, directors, staff, and volunteers from claims, damages, and reasonable costs (including legal fees) arising from your misuse of the Services, your content, or your breach of these Terms or of any law or third-party right.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Before filing any claim, we agree to first try in good faith to resolve it informally by email for 30 days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York, New York, and you consent to their jurisdiction. Each party keeps the right to seek injunctive relief for intellectual-property or unauthorized-access matters.

13. Term, Termination & Changes

These Terms apply while you use the Services. We may suspend or end access if you breach them. We may update these Terms; the “Last updated” date will change and, for material updates, we will provide more prominent notice. Continued use after a change means you accept the updated Terms. If any provision is found unenforceable, the rest remains in effect.
